Rob’s client was an assembly worker for a large manufacturer. The client had been a long term employee with the manufacturer and had a generally good attendance record, but for a few absences due to injuries in the workplace. Overtime however the client developed numbness and tingling in his arms. Assessments showed that the client had developed degenerative disc disease and that there could be some nerve impingement occurring along his spine. The client developed pain that became chronic and eventually the client was unable to continue working. The client went on disability and received disability payments for two years. After two years, the insurer had an assessment completed by a vocational assessor and the assessor identified jobs that the assessor felt met the client’s education, training and experience. The disability insurer denied our client any further disability benefits on the basis that they no longer met the definition of disability which changed after the two year mark to any occupation based on education training and experience. We examined the assessors work and had it reviewed by another vocational assessor. The review highlighted that a number of positions require an education level that our client did not have and given our client’s age and current state, any expectation of retraining and further education was not feasible. We also arranged for a functional abilities assessment which showed that our client did not have the physical ability, stamina, to maintain any reasonable effort of work, even on a part-time basis. We arranged for a settlement mediation with the disability insurer and we were able to obtain an excellent settlement for our client which represented almost all payments for our client to the termination date of the disability policy.
